• Daniel dived at the hand holding the gun just as another shot was fired, but it missed its mark as Daniel twisted Ben's hand and the shot was fired at the bed stand lamp instead, it shattered and debris of glasses fell across the floor.
• Both Daniel and Ben fell on the bed with Daniel still holding Ben's hand and trying to take the gun from him while Ben struggled against him
• Daniel was situated astride him and he brought up one knee and placed on Ben's windpipe, cutting the flow of air
